The two charges are independent. If you have a weapon and defend yourself, but you shouldn't have the weapon, that's not an automatic murder charge.
Self-defense is already difficult to prove in public space with a duty to retreat--if he arrived at the riot while illegally open carrying a firearm it pretty much undermines any self-defense case imaginable.
