It was nominally kept in place for SCOTUS but never was tested under Obama because there was never a vacancy there for the GOP to obstruct from the minority. By the time Garland came up the GOP had held the Senate and obstructing for years across the federal judiciary and this was just one more. They couldn't get a relatively easy nomination of Gorsuch through without eliminating it.
