It's neither Assault, nor Battery. You didn't hurt them, so it's not battery, and assault is the threat of hurting someone, which also wasn't the case.

The best you could get is personal damage for a t-shirt maybe getting ruined and a lost hat. But that's, what, at best $50? You would get that case immediately thrown out, probably with prejudice because it's $50 and the courts have other shit to do.


Uh no, that's battery. It's also theft for that matter. It could even be considered robbery since the guy took the item under the threat of violence.
