By your logic he should have taken damage for saving the ACA. This isn't really a hard call for even the vulnerable Democrats. It might have been before the allegations and I think in the alternate universe where they never surfaced you might have had one or two of them switch over and confirm... but we're not in that universe. McCaskill already has declared herself a no vote, and based it on Kavanaugh's views on executive power and dark money. Jones has been a harsh critic on how the Republicans are running this hearing, so if nothing else he can object on process. Manchin is pretty much always with the Democrats when it counts. Which leaves Heitkamp, Tester, and Donnelly but I expect them to come on board too.
