Oh, and you guys know this is not just about illegal immigrants, right?

This is about immigrants.

It includes people who have immigrated to this country, passed the pee test, etc. And it's about whether or not the federal gov't is allowed to detain them prior to deportation proceedings.

Kavanaugh's stance is that we have a '96 law on the books stating that if they've committed crimes, even minor ones, then they can be held whenever, even if they've long since been released from police custody.

Gorsuch's like naw that's dumb.

The plaintiffs include people who entered the country illegally, tourists or students who overstayed their visas and lawful permanent residents. Among them are immigrants who arrived in the United States legally as infants, committed minor crimes like possessing marijuana and were detained years after completing their sentences.


Basically, are you an immigrant? Did you commit a crime on this here list, some of them minor? Then, the feds can hold you as long as they want, and bring you in whenever they want, even if the cops released you years ago.

The Breyer response was to at least allow them bail hearings if federal authorities were making moves to detain them, because as it stands now, if you're detained, you don't get a bail hearing.
