That's true, but what he should have done is make adjustments to their lifestyle, especially their kid's lifestyle over that year so that he could argue that the extravagances where self-inflicted. Like take them out of private school, etc. If he knew the kids weren't coming with him he should have planned accordingly. He didn't, and now he's paying the price.

What's really fucked up is that they let the ex-wife keep the standard of living despite his steep drop in income. Even more so that she's continued to rack up this debt on the assumption that he would be able to pay it back. That's just irresponsible.
