Literally speaking, a person who performs an abortion on themselves is a person upon whom an abortion has been performed, but I suppose it's not out of the question a court could find that "upon whom an abortion has been performed" means "upon whom an abortion been performed by another person."

Actually, that doesn't necessarily follow. It would be logically consistent to be against punishing women for getting abortions if you believe women are inherently incapable of making their own decisions. You know, kind of like how dogs aren't thrown in jail if their owner uses them for dogfighting. One could believe punishing a women is pointless for similar reasons but still support punishing the other people involved.


This is the logic the US Supreme Court used 100+ years ago to uphold an Oregon law setting a maximum number of hours per week women could work after striking down a New York law setting a maximum number of work hours for everyone.
