As abhorrent as I think it is, I can't offhand think of a legal reason he can't. Well, asylum laws notwithstanding, of course - which is definitely a thing here but that's a different discussion. Similarly, it's why I think SCOTUS will find that Trump was allowed to rescind DACA. I'm guessing they'll actually find such on much the same reasoning I'm employing here - the government has prosecutorial discretion (and the courts have generally found it is not their place to interfere with that judgment.)
