| Snrkiko 12/10/19 7:02:15 PM #228: | there are no penalties other than eventually dismissal of the action, either with or without prejudice. dismissed with prejudice means they can't come back and try to revive the lawsuit. without prejudice means the judge is giving them another chance to come back and revive the case but until they do the case is thrown out. there's usually no penalty for filing a lawsuit for "wasting time." after enough bs cases, a person or entity can eventually be found to be a vexatious litigant, but this is a pretty high bar (and might not apply to TX). you might be able to request the judge issue monetary sanctions against the company if they refuse to follow court orders or seem to be acting in bad faith, but again that's a long shot. all of the above is my understanding from California civil litigation. there might and probably will be differences in your situation. --- ...Snrk.
