Yeah, that seems like it's a case of "because the law didn't prevent it, we added other safeguards, and those might be undermined by making it illegal." Though I'm not sure I fully agree with the "they'll just get married unofficially" justification. They can already do that, and the whole point of making child marriage illegal is to close the marital loophole on statutory rape, which an unofficial marriage wouldn't circumvent. That said, the fact that it's PP and ACLU pushing back and not some creepy evangelist cult does help reassure me that the goal is actually to maximize child welfare instead of grasping at straws to justify retaining loopholes for the sake of permitting child exploitation.
