You're right on both parts, in fairness - it definitely wouldn't apply here because as we mentioned, Yuzu fucked up pretty bad on how their paywalled version was handled and updated. The narrow precedent basically just means you have to maintain plausible deniability on anything you're doing with them, though that obviously wasn't possible when they were doing game-specific updates on a game that was more than a week from release. Generally speaking though most emulators manage to float in that narrow realm of legality, though cynically that still doesn't stop a company like Nintendo from just throwing lawyers at anyone they don't like until the group is forced to shut down, regardless of the validity of their claims.
