A non premeditated murder would be something like you started beating the shit out of me and I just happen to die. If you start with trying to kill me, that's always premeditated. This is true, yes. If you planned to kill, no matter for how long, it's premeditated. The only time it's blatantly not premeditated is if you have a way to argue that you didn't expect death to occur from said actions, such as "I just pushed the guy, I didn't expect him to fall and hit a rock in a precise enough way that it broke his neck."
