A Texas man is battling a court order that mandates he must pay tens of thousands in child support for a child whom he did not biologically father and whom he met only once.

In 2003, a child support court in Texas ruled that Gabriel Cornejo, 45, had to pay child support to his ex-girlfriend, who had recently given birth, because she vowed there was no way he wasn’t the rightful dad.

Texas’ family code, chapter 161, states that even if one is not the biological father, they still owe support payments that accrued before the paternity test proved otherwise. In Cornejo’s case, that amounts to some $65,000.

Its sort of a fair, next IMO. He was ordered to pay it and didn't. If he felt he wasn't the father he should have had a DNA test sometime over the last 15 years to dispute the order.

Wait...so he was court ordered to pay child support, but wasn't told about it. So apparently the trial was held without him present, which is already a pretty fucking stupid idea in the first place.

Then they took money out of his paycheck several years ago for it, so apparently they have that ability, but for some reason did not continue to do so? And I guess he didn't notice that his paycheck was lower than usual?

None of this makes any sense. Fucking Texas. -_-

as to why this is legal. basically the way the laws are set up in many states is that if you don't contest paternity within a certain amount of time, guess what. You're fucked. If you aren't aware of it, like they serve papers to the wrong person or different address, you're still fucked. If you don't pay, well, welcome to modern day debtors prison

Cornejo, who is currently raising three children of his own and two nephews, claimed he was not made aware of this and only found out about the child support payments last year when a deputy served him with court papers claiming that the state of Texas lists him as having another child.

His ex-girlfriend’s attorney, Carel Stith, claimed that money was taken out of Cornejo’s paycheck several years ago and he didn’t contest it, and that in itself can satisfy a court argument that he should have handled the matter long ago.

This is some BS code, but wouldn't he have noticed that they were taking money out of his paycheck sometime ago? >_>. I would imagine having a large family like that already that he'll be more keen on his finances.

He was garnished only 3 times for $31. He probably thought it was fixed once they stopped garnishing his checks. I wonder if he didn't go to the court about it because it would probably cost more in time and money to get the $93 cleared up than the $93 he would get back.

Isn't that why the person notifying you has to say "You got served"? To be able to testify that s/he did indeed serve the papers to the right person? Otherwise, it would say "unable to locate" or something like that.
