BURTON (WJRT) - (07/19/18) - A Burton firefighter was suspended without pay after he allegedly pulled a gun on two people over a fireworks dispute while he was off-duty.

Rachel Duker says on the Saturday after the Fourth of July holiday she and her fiancee were cleaning up fireworks debris in their front yard when a man pulled into her driveway to confront them.

The man, upset they were lighting fireworks, lives on Sandy Lane just one street over from Rachel's home on Surrey Lane.

"He says he had to work in the morning so we both apologized," Duker said.

But that apology didn't end the argument. It only escalated when another person got involved.

"As we were kind of going back and forth with him, a woman pulls up and she jumps out of her car. She runs into my yard," Duker said.

Rachel said she was on the porch with her two-year-old and five-year-old when the woman started yelling. She says she told the upset pair to call police if they had an issue, and she repeatedly asked them to leave her yard and driveway.
"She used some profanity, said she wasn't going to get off the property and that she wasn't leaving, wasn't going anywhere," Duker said. "At that point I came off the porch and I said, 'please I am asking you to please leave. You are scaring my kids.' At that point when I stepped toward her she drew a gun on me."

Then she says the man also pulled a gun while still sitting in the vehicle that was parked in the driveway.

"When I looked over to the man sitting in the vehicle he also had a gun on me and the gun had a laser which was also even more surprising," Duker said.

She called police and that eventually ended the dispute.

Rachel later found out the man who pulled up in her driveway is a Burton firefighter named Albert Hardy. The 46-year-old, 18-year veteran was arraigned on two counts of assault with a dangerous weapon (felonious assault). The woman who also approached her home and allegedly pulled a gun is also in some legal trouble. Police have not divulged those details at this time.

Rachel is filing a civil lawsuit and wants to see action taken against Hardy.

"I don't think he should hold a public servant job at all," she said.

Duker says she's had such bad anxiety after this that she's moving and will get counseling for her son who was traumatized.

ABC12 reached out to the firefighter involved in this incident through the Burton fire chief but did not hear back by deadline Thursday. Hardy is suspended without pay pending the investigation.

Some insanely fat cops out there as well. They usually end up having desk jobs and that's it. That dude likely hasn't left the fire house in years and if he has, he's probably only a driver and doesn't actually fight fires.

idiots. you can't pull a gun on someone when you are the tresspasser. there is no excuse. and none of this was needed. the story says that the fireworks were over. they were cleaning up and there was no more lighting going on. so I don't know why started fighting. you got through it. it was annoying but the noise is gone. move on. waiting for all the noise to end, and THEN going over and screaming when they are already done, is stupid.

I'm not sure what his role is there anymore. I know the gig has always been part time. He works full time at a hospital repairing machines.

I find it hilarious he drove to another street to investigate with his wife guns ready in case needed to find this house. Then he proceeds to sit in his vehicle with a hand gun pointed at the home owner with kids outside while his wife also has a gun pointed at the home owner in their yard.

From personal knowledge he's the type of person with controls issues to the core that if he doesn't get his way or someone disagrees with him he gets violent or very verbal.

Firefighting is technique, not "fatness". Plenty of gym-obsessers getting there as kicked at my job by the house and roof, and plenty if big guys kicking ass.
