So quick run down. I clocked out and sat with another coworker who was clocked put. He also happens to be a supervisor at my restaurant, although on this particular shift tonight he was serving. A supervisor basically means you hold management responsibility on your shifts, but you are still ranked below the managers and GM.

As Im talking with him, he tells me I could get a beer, even saying that 12 oz is legal in our state of California (which turned out to be not true, theres actually no state law prohibiting drinking on breaks). So I order myself two 5 oz beer tasters to try out some new beers we have, while sitting in the cocktail area.

At the end if my shift, I have a talk with my GM and another supervisor. My GM explains that its against company policy to drink on our breaks and that I should have known this, despite the supervisor sitting next to her admitting that she didnt know about the policy herself later on in the conversation. I was then told I would be suspended until my GM can get in contact with the district manager to discuss where to go from here.

Oh and also, we raft new cocktails and new beers all the time at my restaurant. This decision makes little sense to me and I dont know what to do from here.

Can you verify in a company handbook or policy that it isn't allowed to drink during your break? Because if its not clearly noted, then you are okay. I wonder if it actually says some stupid shit like its ground for suspension and/or termination. Maybe your GM is a dick. I dunno. I would have given you a warning if it was really against it and asked for an explanation.

So sorry you have to go through this. There could be a silver lining to all of this.

To me it's common sense not to have any booze in your system while working but with what the supervisor did it's kinda like entrapment. Maybe not intentional entrapment but still they should take the heat and you just get told not to do it again.

Shit I'm constantly taking heat for what new hires do cause I'm a trainer and I should have corrected them. Which I find bs. I'll tell them but I ain't gonna make them unless I'm actively their trainer.

Its not uncommon that if you work in the food and beverage industry that they want you to try the products so you can speak with some degree of knowledge when customers ask questions. Nobody is talking about getting hammered at work.

If they say anything to you or contact you don't engage in any conversation with them. All you do is say that you will consult with your lawyer first and get back to them. If this is just some one off small place then they would be scared shitless of being sued. Most restaurants now are barely getting by so even a court case they could win might put them under.

Hopefully that will get them to unsuspend you, but as others have said you should probably just look for a new job anyway.

Sounds like your GM is shitty. That shouldn't have been anything more than a verbal warning at best, but dude spiraled out of control due to "procedure". He probably did a whole investigation and everything and then had to bother the DM too. You'll most likely get a review of company procedure and a write up, which functionally means nothing.
