Whereas the current strategy literally forces Merchant to say that these things aren't true in court. While legally speaking the end result would be the same, there's actually far more strength in forcing your opponent to openly admit in the courtroom that they've been lying about everything, as opposed to just not letting them lie about anything. I think the biggest problem with the length of time for her was the large number of people involved and many of them were uncooperative targets or witnesses. Some of them being current elected officials in Georgia, even. In the classified documents case, I can't remember when the investigation started, but Judge Cannon added months of delay in the criminal investigation phase on her own by improperly stepping in and assigning a special master. After about 3 or 4 months, the 11th circuit court of appeals ended her shenanigans.
