FYI for those not adept in US History, this is called a "pocket veto" when the President waits for Congress to adjourn to try and make decisions to go around them with regards to Appointments and laws.

pock·et ve·to
ˈpäkət ˈvēdō/
noun
noun: pocket veto; plural noun: pocket vetoes

an indirect veto of a legislative bill by the president or a governor by retaining the bill unsigned until it is too late for it to be dealt with during the legislative session.

In essence, yes. It's more about protecting Mueller though.

He can still fire Sessions.

But he can no longer bypass the nomination process by making an appointment during break. The replacement he picks would have to go through the same vetting process and have a confirmation vote.

Something as simple as this should have been changed a long time ago.

Well that's what I was trying to say. All Presidents try this stuff.

Abraham Lincoln pocket vetoe'd General Sherman's order to give ex-slaves 40 acres and a mule.
