https://www.opb.org/news/article/npr-they-know-im-different-deportee-struggles-in-iraq-after-decades-living-in-us/

tl;dr

Man was brought to US from Iraq when he was two.

He grew up in the US, got a degree, got a job. Legal resident.

He also got a conviction for assault on his brother-in-law. Served three years.

In 2017 he was part of a sweep by ICE looking to accelerate deportations.

He hasn't lived in Iraq for decades. He barely speaks Arabic. No one in Iraq trusts him. He struggles to find work. He's been beaten. He lives in a makeshift house.

As a legal immigrant who became a citizen myself, I dont really have any sympathy for the guy. Ive never assaulted anyone let alone my own family.

Out of morbid curiosity I googled his name to see if his case came up, because 3 years is a long time for an assault charge:
https://www.gpo.gov/fdsys/pkg/USCOURTS-mied-2_11-cv-15668/pdf/USCOURTS-mied-2_11-cv-15668-0.pdf

He didn't just attack someone. He and his three brothers broke into the guy's house and beat him with the intent to kill him. He was only acquitted of the "intent to murder" piece due to it relying the witness testimony only.

EDIT: and his appeal was denied with prejudice so the evidence was apparently sufficient enough for the court to not only deny his appeal, but aggressively deny it.

99% of the time I find these SOB stories about some poor innocent person "caught up in the immigration system" and being deported boil down to someone who deserves it if you do even the barest amount of digging.

Are you seriously trying to say a guy made a mistake paid for it and then was a model citizen for years deserves to be deported into a country where his only connection is that he was born there. He had a family a job and actually contributed until he was deported separating him from his family

Shimary says he ultimately agreed to be deported after Immigration and Customs Enforcement officials falsely told him that if he didnt, he could be imprisoned for 10 years for resisting deportation. ICE agents pressured him to sign a document from the Iraqi Embassy in Washington, D.C., consenting to be sent to Iraq, Shimary says.

They even tricked him. The fuck is wrong with you people

First off, you're taking it at his word that he was tricked. It's possible, but this guy also tried to group murder someone, so excuse me if I doubt his excuse.

Second, who says he was a model citizen? Him? Are you suggesting that some guy was just the perfect dude decided one day to try and murder his own in-law, and didn't do anything before or after?

Because of what was written in the court documents and details as to why he was acquitted, but go ahead and continue trying to bait me without knowing anything about the case.

This seems like a case where we should have some sort of system in place for automatic citizenship. It doesn't make sense for someone living in America since they were two to be eligible for deportation.

My original complaint was the story intentionally obfuscated facts to make the guy seem like more of a victim than he was, not that it was the fairest of punishments. While you're trying to make immigration officials out to be bond villains you should at least find better examples than a guy who tried to murder his in law.

And my counter complaint is that you're focusing less on the fact that he served his time and was trying to better himself, and more on the fact that he committed a crime and using that as justification for his deportation. It's not like I glossed over the crime. It's right there in my first post.

You've decided that the crime he committed is the most important aspect of this story.

Under US law, this man served his time. Suggesting he deserves additional punishment well after the fact because he was born in another country is not something I cotton to. This man remains a victim of our immigration system.

And don't mistake my intent. ICE officials in my mind are not Bond villains.

They're a fucking gestapo.
