I always thought it when such things happened it was whichever character was stated first in the post that was considered saved.

Though it should be Crocodile who is saved anyway since Suor would have picked that.

I always take the first saved by the person if it's an invalid vote. I don't wait for a choice usually since that might require me putting off the round (let's pretend I was up that early), so keep that in mind.
