Felix is worded completely differently is what I'm saying. Silent protag does not mean they cannot talk.

Also worth noting that I've already used this ability to deny magic in the past. (and failed once against Kefka cause his passive prevents it)

The official definition of Mute in DDS is "disabling attacks that require MP". Transform is a magic spell that doesn't require MP, therefore it wouldn't be effected by Mute. Plus there are other storyline/gameplay reasons for transforming not being stopped by Mute.
