Given that bit of information this would allow legal wage theft. Make it policy to do PTO and then not having to pay employees their accrued hours... That is gross. In a right to work state with no protection laws they could be firing employees that accumulate a large number of hours and nothing would happen. :/

In addition to this, the the very article that ErikP linked to clearly states that the choice to have extra time off or traditional 1.5 pay is the employee's, not the employer's. It also points out that coercing an employee to take time off would be illegal. But that's Erik for you. You realize since that overtime bill was passed most employers just stopped giving anyone overtime altogether so employees couldn't make more money from their job even if they wanted to.
