And is it really 'screwing' someone out of something when it's something they shouldn't expect to have anyway

The law states that 40 hours is a standard work week. Anything more than that is considered OT and is to be paid at 1.5x.

This isn't an entitlement or an expectation. It's the fucking law.

@Zangulus

i work in texas. also if i get fired or quit i don't get a PTO or Vacation check. i got to make sure i use up both before i quit.

No Texas or federal law requires employers to make payouts of accrued but unused paid leave

Fuck. Another reason I never want to live in Texas. Ew.

There's no laws to guarantee that all employees are paid for hours they've worked and banked? What the heck

Given that bit of information this would allow legal wage theft. Make it policy to do PTO and then not having to pay employees their accrued hours... That is gross. In a right to work state with no protection laws they could be firing employees that accumulate a large number of hours and nothing would happen. :/

"I'll gladly pay you Tuesday for a hamburger today" has become "I'll grudgingly work overtime today and may not be entitled to compensation for my labor at a later date"

Likewise, there's a law preventing MANDATORY OVERTIME, such as for teachers... right? RIGHT?

If it passes. Which it doesn't look like it will. There's not enough votes in the Senate to get it onto the President's desk.

What you really mean is not enough votes to block a filibuster =p Because that's the current state of American democracy.

You mean the usual state? Yes, that's why it won't pass. Not having enough votes usually means you it doesn't continue down the line.

You actually think they'll give you more PTO instead of whatever the standard is for that company? No, they're going to take it out of your PTO. And even if I'm reading this wrong, you're still getting paid less.

That's the whole fucking point.

Jesus Christ. They're not taking time from your PTO to pay you for working more hours. That's double fucked.

No, they're giving EXTRA PTO to make up for the lack of overtime pay.

Yes it's less, but you have it wrong as to how.

In addition to this, the the very article that ErikP linked to clearly states that the choice to have extra time off or traditional 1.5 pay is the employee's, not the employer's. It also points out that coercing an employee to take time off would be illegal.

But that's Erik for you. Misunderstanding what he reads and then over reacting and making himself look stupid.

I might have misunderstood it but you're still getting paid less with this bill.

You realize since that overtime bill was passed most employers just stopped giving anyone overtime altogether so employees couldn't make more money from their job even if they wanted to.

What? That doesn't even make sense, seeing as it isn't law to begin with...

Do you have statistics to prove there's been a significant drop in overtime being used in the last week?

I think it should not be the company's choice, but I'd prefer paid leave.
