They want both.

My job allows both and it pissed me off. Lot of them take advantage also, 10 minute smoke break once an hour and still get their 30 minute break for lunch. That's over an hour and a half a day break reward for smokers, and non-smokers get the regular 30.

There should be a new "fresh air break" put into place for those of us who want to go outside for 10 minutes and not smoke.

Well if they're smoking a cigarette every single hour of every work day they're probably at at least a pack a day which means they're probably spending $100+ a week to slowly kill themselves.

I've never worked nor has anyone I known worked anywhere in California where you got more than two 10s/15s and one 30. Smoker or not.

Also non-smokers get the exact same amount of time.

Fault your state not the smokers if your situation is different.

Yea even here in NC it's 15-15-30 every two hours on a 9 hour shift.

Better than my last job where it was 10-30-10.

They're right: smoke breaks don't count as breaks.

You can argue that they shouldn't be right, and I wouldn't disagree. But can't argue with reality.

The problem is that a lot of people smoke. Unless you work in some tiny little business, there is a non-insignificant number of supervisors and managers who also smoke. Not allowing your workers to get smoke breaks would severely limit your hiring pool and thus the growth of your business.
