Most crimes can be determined in court with physical evidence, but the only thing that separates a rape from consensual sex is consent, something that is easily twisted to either side's advantage.

On one hand we have real victims who can't prove that they gave their assailant consent, allowing rapists to get away with it, and on the other hand we have people who can't prove that they had consent that get sentenced to years in prison because the "victim" either changed their mind after the "assault", or they were scheming it the entire time.

Laws in place are also contradictory to the point where it does much more harm than good. For example, a man can't be raped by a woman according to the legal definition because it doesn't involve penetration, however to determine the difference between rape and consensual sex the only thing the court is supposed to determine is whether or not permission was granted.

It seems like a double-standard to me that when the whole point of the trial is to determine whether or not consent was given, men who were forced to preform sexual acts for women would not also be considered rape, considering this too requires consent. This all leads back to the factor of proof. It's difficult- if not impossible- to prove most cases of rape, and equally as difficult to disprove them.

So what should happen to an accused rapist when there are only accusations and no solid proof? Should we take the victim or the suspect by their word? Should we convict the innocent in an attempt to punish the guilty? Is it worth the risk? Or should we let a potential rapist go free so that it can happen again and again because there's no proof?

Neither of these sound like justice, there has to be a change, there has to be a way to prove consent. How would we go about this, we can't exactly create a "Contract of Consent", it would be too easy to manipulate, how on earth could this nonsense end? Does anyone have a plausible solution?

Rape investigations are only a joke on college campuses because they have a much lower bar for guilt and think that challenging the woman's story is "traumatizing."

In actual courts, the investigations are done professionally, the same as with any crime. If a trial it comes down to a coin toss or ambiguous he said-she said, the benefit (under reasonable doubt) goes to the accused.
