A dog in my neighborhood suddenly ran out into the street and I had to brake hard. I freaked out because instead of walking back to the yard, it walked to the side of my car.

I had to get out and shoo it away for fear it would go under my car for some reason. There was no owner (nobody at all actually) outside at the time.

Depends on whether you were speeding. However, if you hit an unleashed dog away from its property while driving the speed limit and it damages your car (which it probably wouldn't if you were driving the limit since you'd be able to brake in time, etc), you might be able to sue the dog's owner for damaging your car based on a neglect argument.

So did you hit it?

No, but it was close enough that it made my butt pucker.

It's basically going to depend upon three things:

- How negligent (If at all) you were. Speeding, location, etc.

- If you have proof and can back up anything. Preferably a dash cam.

- Who's dog it is. If they can pull strings or afford any sort of legal power, or simply are a business owner.

None. Actually if you go out of your way to avoid hitting the animal and accidentally destroy your car in another way, you're liable for all of that. Sometimes the best thing to do is to keep driving without stopping, as mean as that is. You want to save the dog's life, but honestly if you swerve and hit a light pole, the city and your insurance are going to put you on the hook for all of that shit.

Not liable at all usually even if you are speeding. I don't know why these people are bringing it up. In most states there's strict liability against dog owners if their dog causes bodily injury or property damage while it's out of their control or at large.

You could even get a citation for speeding but that's unrelated to the fact the dog was at large. It's two separate infractions. It's like if someone were to rearend you while you're at a red light but you're drunk driving. You may get arrested for drunk driving but they'd still be liable for your damages.

The leash claim would be easy to prove.
