In all fairness, she may not have known she was illegal beforehand depending on how she was hired.

If, for example, she saw the maid's ad for her services and decided to hire her, it's not as if she would have done a background check on her.

However if she actually hired her as an actual employee, that's a different story. Does the article touch on which of the above is the case?

She [the victim] noted that after Mendez Ortega took the rings, she lied to the cops, she lied to her employers. She didnt turn in the rings she made somebody else do it. She confessed but claimed that the rings were in the bathroom. And then she tried to blame her boss.

And the victim claims Mendez wrote a letter of apology, recommended by the police, but she never saw it.

I mean, she has a rough life, but I'd still be pissed if I found out a thief got off like this. Though I do understand her motivations, she's doing what she can to survive.

If she didn't confess and give the items back, would she have gotten away with it if no one else talked?

i feel the opposite; it's essentially ignoring the legal guidance. this allows an unjust guidance to remain in place.

what needs to happen is these cases be forced to follow the guidance and produce a necessary reaction from the public such that the guidance is changed.

otherwise, the law will continue to be applied unequally.

We need to be honest here - if human emotion wasn't involved in most cases a bunch of people would be in jail, including 90% of the posters on this very board that are all about obeying the law.

This one case does not remove a set precedent; she wasn't the first caught stealing and she won't be the last - and the article itself is the only thing that makes this a point of reference for other cases, which still won't mean anything.

She could have just as easily kept them or pawned them. Yes, she needed a push to make the right decision, but the hypothetical that she might or potentially would have done something is out the door precisely because of how the events played out.
