Key Points: 1- I was shoved and had a door almost closed on me 2- I recorded this. 3- I told the police officer what happened and that he didn't physically hurt me and I wasn't scared. 4- Police talked to him. 5- Police left. 6- I called the police department to ask why no arrests were made. 7- Was told I had nothing to go off of 8- Showed him the video. 9- He continued to say he had nothing to go off of. 10- I had some errands to get done and when I came home, my girlfriend told me he was being arrested. I looked up our local county jail roster and sure as hell he was there for an outstanding warrant stemming from a DUI a number of years ago. Nothing about 5th degree assault, or disorderly conduct, etc. I am told essentially that since I said I wasn't injured or scared (and actually I just meant that while the officer was there, I wasn't scared) that he can't go forward with prosecution. I won't get into the reasons why but I was very careful to not say or do anything that could in anyway be misconstrued as disorderly conduct or assault, so I let him say what he had to say and do what he wanted to do, documenting everything, figuring I wouldn't take the law into my own hands or possibly scare any of the residents. I read the papers all the time. a chick got arrested for taking a piss in an alleyway behind a bar (who the f*** cares?) if I do 5 MPH over the speed limit, there's a chance I'm getting pulled over. just seems strange how I've always been told that touching someone in anyway can be deemed harassment or assault, yet no one was charged. Seems strange to me that in the same sentence you'll point out how ludicrous it would be for someone to receive the hard arm of the law over something minor, and at the same time complain about how ludicrous it is for someone to not receive the hard arm of the law over something minor. Little stuff like this gets taken at a case by case basis. It might be that they assessed there was no threat and this was just a minor domestic dispute best resolved by having a chat with all parties.
