James Alex Fields Jr. appeared via video conference for a status hearing in Charlottesville Circuit Court Wednesday, January 3. He is charged with first-degree murder, five counts of malicious wounding, three counts of aggravated malicious wounding, and failure to stop in event of injury or death. All the charges are felonies.

Fields was seen taking part in Jason Kessler's Unite the Right rally at Emancipation Park with Vanguard America, a known racist, right-wing group, on August 12. He is accused of ramming a car into a group of people marching in the area of 4th and Water streets in protest to Kessler's rally. Authorities said a total of 36 people were injured, some seriously, including 32-year-old Heyer.

A three-week jury trial for Fields is scheduled to begin November 26.

1st Degree is probably over charging. They'll say he saw crowds of people surround him, he panicked and hit the gas. It'll be tough to pin pre-meditation on him.

That's my concern with that particular charge. I would hope some logic in favor of the victims prevails here with the video evidence of him peeling out and plowing into people will be considered premeditated, along with the fact that he fled the scene... But who knows these days.

That's my concern with that particular charge. I would hope some logic in favor of the victims prevails here with the video evidence of him peeling out and plowing into people will be considered premeditated, along with the fact that he fled the scene... But who knows these days.

The premeditated charge might be supported from the organization thread on the discord. Also acts of extraordinary violence committed during the murder can be charged as first degree. If you torture someone and they incidentally die you're within that definition.

This is what I was thinking. If it was talked about beforehand, whether jokingly or not, that's premeditation.

The initial engagement with the car was outside of the crowd of demonstrators. He actually drove into them and then got swarmed.
