Matt Furie, the cartoonist behind the popular Pepe the Frog character, has sued radio host and conspiracy theorist Alex Jones Infowars website over selling a poster depicting the frog without Furies consent. According to the Associated Press, which earlier reported on the lawsuit, Furie is alleging copyright infringement in a lawsuit filed on Monday in Los Angeles.

Infowars visitors are able to buy posters featuring Pepe the Frog next to President Donald Trump and a variety of right-wing personalities, including Milo Yiannopoulous. Jones is also pictured next to the frog. According to the AP, Infowars is selling a MAGA poster featuring Pepe the Frog for $30.

For his part, Jones, who leads Infowars and is one of the more controversial figures in America, called the lawsuit frivolous. He added that Infowars will fight back, adding that the law is on our side.

Furie has been engaged in a battle to protect his copyright for the last several months after he discovered a variety of websites and organizations using the Pepe the Frog character in materials they were selling. One of his attorneys, Louis Tompros, told the AP that Furie is engaged in a game of whack-a-mole to take on those who he believes have violated his copyright.

Pepe the Frog has been an Internet sensation and meme for about a decade. The frog, which was created in 2005, has a humanoid body, and has appeared in comic books. Its also been used in a variety of alt-right capacities without Furies consent.

As of this writing, Pepe the Frog posters have been removed from the Infowars online shop, which houses a variety of products, including water filtration systems, emergency survival food, and stickers promoting Jones and the site.

Remember when they tried to ban Pepe as a hate speech terroristic icon?

And now this?

Jesus reality is stranger than fiction. If you wrote a movie about this shit people would have said "This is too unrealistic you clearly have no idea how the internet and memes work."

Yet here we are

That's what makes it interesting. If the guy has truly been on a persistent copyright hunt he might have a case because at least with copyright the US operates on a "use it or lose it" mindset. If this was his first case about it he probably would have it tossed, but if he's been fighting for ownership since its creation he may actually have a case.

That is, except for arguments for public domain. Courts might be reluctant to set precedent that something becoming a meme means ownership over said art is automatically transferred to PD because anything can become a meme. However, there IS precedent that at some level a thing that's part of the public conscious can't be owned.

It'll be interesting to see how this plays out if it goes in front of a judge, although my guess is what'll most likely happen is they'll settle out of court.

Yeah I agree.

I don't see any way Jones can win this that won't cost more than just throwing the guy some cash

I could see him fighting it if only for the media exposure. He can make a big month-long stink about the illuminati trying to take him out via finance or something since they can't brainwash him with their gay frog water.

Making memes out of it is one thing, but selling items featuring a copyrighted character is definitely not allowed. You can't sell posters with, let's say, Batman either without the proper license.

Yeah, the sales of it are a big no no and while it shouldn't be anything major and a financial settlement and agreement not to sell the likeness, Jones will probably make a huge stink about it being some attempt to censor and shut him down.

Just like a few days ago when he claimed YouTube was about to ban him

Pepe isn't just some random drawing, he's a cartoon character created and owned by a cartoonist and featured in published and copyrighted comics. Making internet memes with him is one thing, but using his Image, without permission, to sell merchandise is definitely out of line.
