11 y/o Jonathan Benko from Texas was killed after he participated in a school walkout to protest gun violence when he was suddenly hit by a CAR after crossing the road!!

He was with other students when they left the designatd walkout on Friday morning.

The students attempted to cross a busy highway when Jonathan was struck by a Ford F150 truck.

He was at the back of the pack who ran across as they carried signs but the driver did not stop when he saw the crossing students

He sustained critical injuries from the hit and was taken to University Medical Centre in El Paso where he died

Ysleta Independent School District Superintendent Xavier De La Torre said Jonathan was among 15 kids who used the National School Walkout as an opportunity to leave the school to go to a park as they sent parents a voice mail after the accident to inform them what happened

He was a student at Parkland Middle School and his mother works as a nurse at UMC's Emergency Department and his uncle works as respiratory therapist.

The hospital sent out a statement describe the heartbreak that the family is going through and that their thoughts and prayers are with the mother and her family...

no i think the teachers should be charged for negligence as the kid was in their care secondly i very much doubt that the kid has his parents permission to leave school during school hours.

So the group of students were attempting to cross a highway and he was struck by a car.

The driver should only be charged with hitting a pedestrian as, according to this report, he was not paying attention to his surroundings and the road ahead.

However, he also should not be charged with manslaughter/negligence as pedestrians shouldn't even be crossing a highway to begin with. Use crosswalks or don't cross at all.

I need to know more. Under what circumstances did this happen, did the kid just suddenly run out into the crosswalk? Was there a light? Was the driver impaired?

In the UK highways, or correctly motorways, do not allow people to walk on them at all and the police can stop you.

Yes, I'm pretty sure an eleven year old really understood what this was all about... The school totally didn't put this stuff in their heads.

I feel the school should be responsible as much as the driver if not more.

552.008. DRIVERS TO EXERCISE DUE CARE. Notwithstanding another provision of this chapter, the operator of a vehicle shall:
(1) exercise due care to avoid colliding with a pedestrian on a roadway;
(2) give warning by sounding the horn when necessary; and
(3) exercise proper precaution on observing a child or an obviously confused or incapacitated person on a roadway.


Though pedestrians must yield to vehicles when crossing a roadway by any means other than a crosswalk, under Texas law, drivers are still partially at fault for hitting pedestrians crossing in such a manner. It certainly doesn't help that this portion of the highway runs past Parkland Pre-K, Parkland High School, and Parkland Middle School (which is, in fact, on the opposite side of the highway from Parkland Pre-K and Parkland High). Errant children should just be assumed.

Oh, and Jonathan Benko chose not to participate in the walkout, which is why he and the rest of the group of students he was with were crossing the highway to get to the park in the first place.

If this actually happened on a highway, probably not. If it was a normal street then he might have some culpability.

tbh, that's why these teacher-sponsored walkouts are a stupid idea. Even the non-protestors are put at risk at a result of these reckless actions.
