The new law states, in effect, that if you want to have sex you must ask for it clearly, and then hear a verbal yes back, under new reforms announced by the New South Wales (NSW) government in Australia

I guess mute people can't consent to sex in Australia

I was about to say exactly this.

Like what is this even aimed at solving? Are there actually cases where guys are successfully making the argument in court that an unconscious or heavily drugged partner "didn't say no"? Are we seeing cases where the girl actually resists during sex (as shown by evidence) and then the male successfully argues that he thought she was consenting?

The first time I had sex (which was not planned before we were in bed together), both of us had hands all over each other, kissing deeply, but there were no actual words that led into us doing the act. But seeing as I didn't fucking drug him first, I think it would be pretty obvious if he wasn't consenting. Stopping to ask an awkward question like "Are you consenting to sex with me?" would have seriously threatened to kill the mood.

Yes to all of the above. It took long enough for western nations to say " hey, just because these two people are married doesn't mean that they automatically consent to sex with their spouse 100% of the time"

Like, 1950s to the 1980s in most US courts

Yes, as in they are currently, successfully making the argument, and this argument is why they receive a not guilty verdict?

Touchy subject, eh? You can rape somebody without drugging them. It's possible for people to not consent while of sound and stable mind.

And you do know verbal consent can be as simple as "do you want to fuck?" or "want me to get some condoms?" or "should we go to the bedroom?" It doesn't have to be "I, (my full legal name), of sound mind and body do hereby formally request that you, (your full legal name), partake in intercourse wherein genital on genital contact may occur, including but not limited to oral sex, tribadism, penetration with strap-ons, etc. This offer not explicitly inferring any use of bdsm, spanking, blood play, ejaculation inside without use of a condom, swallowing, urination, etc. Do you, (your full legal name) hereby consent to these terms of agreement wherein either party may at any time opt to conclude sexual actions for any reason with a single verbal cue as simple as "stop" as established in prior contracts (footnote to several legal cases of precedence in an applicable court of law that has jurisdiction over the region wherein both of us live). To agree to these terms of use, sign your name, state that you confirm and have it recorded for record keeping, and fill in the captchas."

Yes, there's plenty of cases like this every year. They usually involve an unconscious woman at a party and as she was unconscious or intoxicated she could not consent. But the plaintiff, usually a man, says that she had consented and he wasn't aware of her condition. And more than a few of those cases result in a not guilty verdict because of reasonable doubt and the jury ultimately believing that maybe she had consented while intoxicated and that he didn't know she was passed out.

If you want a name of one such person who has gotten away with that defense, Reid Andrew Dawson from a few years ago.

Yeah, I've never understood that mentality. Do people actually have that tenuous of a grip on "the mood" that an attempt at affirmation ends everything?

Like I've fallen over, slipped, accidentally started coughing, etc. during foreplay and we just laughed and moved on. I can't imagine someone actually wanting to have sex with me and then changing their mind because I confirmed during foreplay that we were going to move to actual sex.

Then there's times where foreplay was only supposed to be foreplay and we both enjoyed ourselves and went back to Facebook memeing. And other times where foreplay resulted in one of us realizing "oh, hey! I guess my body isn't actually down for sex and we should probably shy away from that, but wanna still nom on each other?" and it didn't kill the mood, it helped us set our boundaries even though we'd been together for months by that point.

If it becomes stupidly awkward for too many citizens (for both men and women), the pendulum will inevitably swing back a bit by popular expectation. Reality always has the final verdict over idealism.

I mean they're different because the scenarios I outlined literally disrupt the mood, while the other is just part of escalating it.

No, one is something that happened to happen and was minor enough to not kill the vibe, the other is the literal opposite of escalating as you're bringing it to a screeching halt. Are you serious right now?

You're essentially dodging the question. There's no requirement that you bring things to a screeching halt to satisfy the law. The only reason you're fixated on that is you must have some strange view of how this is going down.

So I ask you again. How exactly are you picturing this going down?
