She probably did, in the same way Trump's team has been exposed as using private email servers several times since then along with a bunch of other politicians. It merited investigation but it's obviously something we're not seriously pursuing since no one has gone after Trump for it either. They're both shitty candidates who didn't play by the rules.

For the record, "intent" or "intended," "knowing," and "through gross negligence" are all varying levels of mental state. Mens rea encompasses more than just one's intent.

She didn't know she sent e-mails? That kind of falls apart when you realized she ordered 32,000 e-mails to be deleted after being subpoenaed.

Also kind of hard not to see it as gross negligence, when she has been working in very high-profile politics for at least the last 25 years. Hell, Comey even changed the wording in his draft I mentioned earlier from "grossly negligent" to "extremely careless."

If the FBI really felt like they could prove she either wasn't grossly negligent or didn't know about it, they wouldn't have had to make up the bullshit excuse about intent.

Well, for one, Comey used that exact phrase to describe her actions in his initial draft, before changing it to "extremely careless."

She was also the fucking Secretary of State and former First Lady. If privates in the Army can understand basic confidentiality protocols after sitting through a yearly training, there's no reason one of the highest ranking government officials in the entire country wouldn't be able to get it.
