I dont know if it is still a hard requirement, but very recently Sakurai said he would have been more hesitant/reluctant to include Cloud had he not met that requirement. My guess is that if it were to happen it would have to be someone really iconic. I don't think the 'appeared on a Nintendo console' thing is a true requirement, but most third party characters important enough to be considered have shown up in some capacity anyway.

Nintendo can choose whoever the hell they want. They will obviously choose someone who can bring in revenue on their consoles though. That's why P5 on switch is very likely. But they can really do whatever.
