Trump said once before that he could SHOOT someone on the street in New York and STILL not lose votes...now his lawyer is peddling that theory and says he can do not and not be PROSECUTED while in office...and now he's using that defense again as his lawyer is now peddling that claim in court!!

William Consovoy faced skeptical questions from a judicial panel as part of a legal battle over Manhattan DA's subpoena on his Tax Returns

He asked a variation of Trump's famous boast that he could shoot someone on Fifth Ave and not lose support and this time he was quizzed on their theory of immunity from prosecution or being forced to comply with requests for documents as part of a probe

He asked Judge Denny Chin "What's your view on the 5th avenue example?" and Chin says "Local authorities couldn't investigate, they couldn't do anything about it?"

Consovoy says "Once a president is removed from office, any local authority this is not a permanent immunity" as he was making the point that the 73 y/o racist could face prosecution at the end of his term

But Chin says "Well i'm talking about while in office. That's the hypothetical question" Consovoy says No while the Judge asks if that's his position

The judge pressed "Even gathering documents that could be used later? Once the president leaves office, that can't be done either?"

Then Consovoy apologizes and says Yes tht can be done but said with respect to the president that they have not sought to enjoin the entirety for a grand jury but says that the criminal process issued to a sitting president is given automatic immunity and that's when he brought up about Trump being able to SHOOT someone on the street and not be prosecuted

Trump made that infamous line in 2016 when he said "I could stand in the middle of Fifth Avenue and shoot somebody and i wouldn't lose any votes"

The key words are while in office. This is correct that a sitting President cannot be prosecuted for any crime, but he can still be charged and have the case held for prosecution after he leaves office. This is done so that a dissatisfied person cannot simply make up a story that the President murdered his puppy and have the President unable to perform his duties as Commander in Chief while locked up behind bars.

Like with any form of diplomatic immunity, it can be revoked. Sure, a sitting President cannot be prosecuted, but the moment it becomes clear it is needed, that person will simply have the title stripped from them.
