Should we just stop communicating with words? Words literally are labels and using wrong words in describing or retelling things will literally change the story.

It's definitely an extremely shitty thing to do to someone and makes you a bad person, though it's unclear whether or not it should technically fall under the category of rape.

While this is rape by deception, why the hell didnt she verify he had the condom on? At some point people need to take responsibility for their own action or in this case inaction. If she took a second to look she couldve revoked her consent. She set the condition and did not verify said condition was met. This isnt like lying about being on birth control which is not verifiable, infact lying about being on birthcontrol or having and sti is considerably worse.

Were they drinking? Were they sober? If they were drinking perhaps the male in this case made a mistake and was not intentionally deceptive? If they were sober then no excuses for his actions that is clearly rape and he should face justice promptly and be locked away.
