YouTuber Corey La Barrie, pictured above, has died age 25 after he was involved in a car crash with Ink Master star Daniel Silva. TMZ reports that Silva is to be arrested for the murder of La Barrie, with whom he was out celebrating his 25th birthday. Authorities in Los Angeles were called to the scene of an accident on Sunday night after Silva, who was allegedly driving the car with La Barrie the passenger, crashed into a street sign and a tree. The pair were out for a drive in a McLaren sports car, but it's not clear who the vehicle belonged to. Silva has reportedly not suffered life-threatening injuries in the crash. The two were transported to a hospital, where Corey La Barrie was later pronounced dead. Silva is currently still in the hospital receiving treatment for a broken hip, but he is expected to be arrested for murder at the hospital or when he has been discharged. La Barrie's mother confirmed the death of her son on Instagram. "He was very drunk and got into a car with a drunk driver," she wrote. "The accident killed him instantly. ... It's just so unfair."

I mean... the driver should be charged, but I can't help but feel this is partially the victim's fault as well. he got in the car drunk. tough situation. I've been in a car with a drunk driver and I will never make that mistake again if I'm even remotely aware they've been drinking.

I understand why celebrities do a lot of the stupid shit they do but I will never understand why they drive drunk

It's way more badass to have a driver sit around and wait for you to finish in the club then getting into the car and being driven home.

Yeah, that's what makes it tough. I don't know how drunk the passenger was so that makes it hard to say how much he knew he was taking a risk.

Yes it does, you have to prove intent to murder if you charge someone with it. Itd be more appropriate to charge the driver with manslaughter.

The drivers in drunk driving accidents should always be charged with the murder/attempted murder of the passengers in their car.

He should be told he murdered his friend, he should be asked why he wanted to murder his friend, and he should be called a murderer.

From what I've mostly seen, the charge is normally Intoxication Manslaughter. Not sure if I've ever seen a murder charge for something like this. The article is probably wrong, unless this is a thing in some areas of the country.

That's my main issue. If the law was changed to make it so it would be applied, I wouldn't have much against it. As it is, proving intent of a drunk driver seems pretty hard from my law armchair.

We don't know all the circumstances, but I think these types of things should be weighed differently depending on circumstances and information that becomes available, even though it's written into law as black and white. There's a good chance both were likely drunk and goofing around in an expensive sports car. Both probably knew what they were doing was wrong.

Scenarios like these just seem different to me than him wrecking into a completely unrelated vehicle that knew absolutely nothing about the driver's sobriety (or lack thereof)

Apparently Vehicular Manslaughter While Intoxicated (California Penal Code 191.5b PC) is a thing, which is also a felony, so I'm not really sure the differences of why this specific incident is apparently being charged as a murder.

You can still buy alcohol at stores and take it home. He was doing a birthday stream with his friends and roomates and they were getting really drunk. Sometime after the stream they decided to go drive somewhere for whatever reason.

This is not true worldwide, which was my point as unless where it happened does treat it as such it feels very iffy to try and push for it.

However, if California does treat it so and can give a life sentence then good, the person deserves it.

So hes been charged with murder and is in police custody.

After the impact, Silva tried to flee the scene according to the police statement, but was "stopped by citizens who came to render aid." Both Silva and La Barrie were transported to the hospital, but La Barrie died.

This. It almost does a disservice to murder victims by claiming this crime is right there with someone who deliberately planned out the death of another person. That said obviously the drunk driver should be charged heavily.
