Like, morally or legally?

Like, I'm sure some could see it as morally bad to fire someone for those reasons, but legally in regards to a judges role, they might be able to make an argument saying why it's not illegal.

Below is what was being argued.

Clayton County, Georgia, fired Gerald Bostock for conduct unbecoming a county employee shortly after he began participating in a gay recreational softball league. Altitude Express fired Donald Zarda days after he mentioned being gay. And R. G. & G. R. Harris Funeral Homes fired Aimee Stephens, who presented as a male when she was hired, after she informed her employer that she planned to live and work full-time as a woman. Each employee sued, alleging sex discrimination under Title VII of the Civil Rights Act of 1964. The Eleventh Circuit held that Title VII does not prohibit employers from firing employees for being gay and so Mr. Bostocks suit could be dismissed as a matter of law. The Second and Sixth Circuits, however, allowed the claims of Mr. Zarda and Ms. Stephens, respectively, to proceed.

My mistake then. I was under the impression that Kavanaugh was ideologically the closer of the two to Roberts. I would have expected him to flip before Gorsuch.

I agree with the ruling.

But the only problem that I foresee is someone pulling out the LGBT card when they should be fired for non-LGBT related issues. I know at work theres this trans-girl who is terrible at her job, no one likes working with her. She doesn't get along with anyone. Very abrasive. Yells at ancillary staff at the hospital including nurses, techs, etc. Calls in sick for bullshit reasons (which means the work is dumped on someone else). Just a bad human being overall. But admin is scared to do anything to her because shes trans. And she has been overheard before talking about how she "feels people treat her differently because shes trans" and how it causes her emotional stress.

Roberts seems to care about being seen as a good guy (unless it involves bowing down to corporations, then he doesn't)

Gorsuch has a lot of classic libertarian ideals, so as long as being gay doesn't effect work, he probably thinks "why should it matter" (now, if that person abandons a company truck because he may risk freezing to death, that is different story)
