Attorneys for former Dallas police officer Amber Guyger have filed an appeal, requesting she be acquitted of murder charges after fatally shooting Botham Jean nearly two years ago.

Guyger's attorneys are seeking a lesser charge, criminally negligent homicide, and a new hearing for Guyger, according to court documents.

"The evidence was legally insufficient to prove beyond a reasonable doubt that Guyger committed murder," her attorneys argued in a court document. They're claiming Guyger had "the right to act in self-defense since her belief that deadly force was necessary was reasonable under the circumstances" because of her "mistaken belief" that she had entered her apartment and found an "intruder" inside, court documents show.

OK, I saw this topic a few days ago, decided to say nothing. Now I think I will.

Amber Guyger isn't the one filing her appeals, her attorneys are. She's allowed a certain amount of appeals on certain levels. These go for ANYONE that is sentenced to a crime. It's not like Amber is sitting there in her cell with this plan to file for an appeal and get out. It's not like that.

These appeals are being filed on her behalf. This is done for anyone and everyone and by NOT doing it for Guyger, it would be discrimination.

Now, Guyger has the RIGHT to decline to use these appeals that are GIVEN TO HER BECAUSE OF OUR CONSTITUTIONAL RIGHTS, not because of any favor to her in any way. Now if she chooses to use these appeals and accepts an earlier release date, that's because of her lawyers and not so much because she's doing it.

Not at all, she's still got her, what? 4 years to serve? Anyways, the attorneys will likely keep periodically pushing an appeal through either focused on evidence (seen or not seen) from the past or any new evidence that may impact the original trial, had it been admitted at the time.

Nothing will get her a new trial unless new evidence that can exonerate her comes to light.

But you know, she'll get out early for good behavior, right? And Covid, which could also cut her time by a lot.

All of this is against her "will", and doesn't change any remorse she might have felt or any feelings she had when she was handed down her sentence.
