32 y/o Brittany Smith, the Vigilante Alabama Woman who shot dead her RAPIST and claimed he was STRANGLING her brother after a confrontation has plead guilty to the murder and was handed 20 YEARS in prison with all but 18 months SUSPENDED!! With Credit time served she will only serve 7 more months

She admitted to shooting dead Todd Smith, no relation, on January 2018 but sought the "Stand your Ground" defense stating he raped her hours earlier and she and her brother, Chris McCallie, lured him to the house and confronted him with a GUN where her brother and Todd then got in a scuffle with her brother in a choke hold and she shot him dead.

Ron Smith, her lawyer and also NO RELATION said "We have no control over a jury or a judge that would sentence her. In any case you've got to weigh what you know and can control with what you can't"

Her mother, Ramona McCallie said she was heartbroken over the outcome and broke down in tears saying "My baby girl doesn't desrve this"

Judge Jenifer Holt refused to step down after she aleged Brittany had tried to alter or destroy evidence based on inconsistent accounts of the event beginning with the 911 call and then destroyed evidence

The physical evidence is also inconsistent with her statements about rape

Her lawyer agrued she should be granted immunity under "Stand your Ground" because she feared todd would ill her or her brother but the judge said she did not need to use lethal force to end an altercation and that her brother was the aggressor since he brought the gun and started it

Brittany then picked up the gun and shot todd 3 times at close range.

A sexual assault nurse documented more than 30 injuries including bruises, bite marks and signs of strangulation but the nurse said there's no evidence of rape but said most sexual assault cases lack physical proof

Judge said it's evidence of physical assault but not sexual

Todd Smith has had a history of violence against women starting with a violent marriage

I agree w/ the judge on everything she said here, and bravo for not being bullied into stepping down for stating facts of the case and having that called "bias"

She and her brother lured him there and brought a gun, and initiated the whole fight. It was an ambush, not self defense.

I remember this story from the last time you posted it.

They lured the guy. Im sure hes an asshole but we have laws.

People need to realize theyre not smart enough to get away with murder. So dont even try. Risks dont outweigh the rewards.

Originally I was going to be like, WTF, but hearing that she lured the guy to her house and basically executed him makes the sentence seem a lot more reasonable. If anything, it seems she might have gotten off a bit light since she's only serving 18 months for murder when she should have just brought the police in and let them handle it.

Rape cases are notoriously difficult to prove and likely didn't happen any time recently. I understand why you'd want to deal with it outside the law.

Not to mention the increase in false accusations and such, which empowers the real rapists to continue their reign of terror.

Oh shit, I saw the 20 years and missed the part about 18 months and out in 7 w/ time served

That's fucking outrageous for premeditated murder. Yeah, the guy was an ass hole and should've gone to prison for assaulting her, but they murdered him.

Assuming he did in fact rape her, I have no issue with her breaking into his house and shooting him dead. If someone has wronged you to that degree, I don't feel like you have a right to complain if they kill you.

Legally vigilante justice is a grey area for me. If the law was always perfect and everyone was brought to justice then I'd be more against it, but obviously if you vigilante kill the wrong person, you are just a murderer. In a case where the law is powerless to bring someone to justice and you know FOR SURE that they did it, I have no qualms about vigilante justice. People are stupid though, and a lot of people are quick to jump to conclusions so I certainly can't support it in general.

So I guess for me it's wrong until you prove that it was correct in that instance. It'd be like if you heavily suspected your neighbor was keeping someone prisoner in their basement and you broke in to check. You are wrong to break in UNLESS you were right in which case good job.

Tbh, I am a bit surprised this doesn't happen more often considering how rare it is for rape cases to be reported -> taken seriously -> taken to court -> found guilty -> given an appropriate sentence and how common rape is.
