How did this mechanically even work anyways - which group even decides this - the prior senators that are about to be replaced (unless they were reelected) or the new group? So they can vote against allowing in their replacements? The new group wouldn't make sense since...they'd have to all be allowed in before it could happen.... For instance, if the power were up to the courts, a politicized court could fill the legislature with members of the same party. So I guess the issue would be, what happens if two "legislatures" meet, each claiming to be the legitimate one and judging its own returns to be valid and the other one's fraudulent? Hopefully, we won't need to find out. Edit: The new legislature decides.
