My brother was rear ended today but the other person did not have insurance. What can my brother do? Is there anything he can do? He has a $1,000 deductible but doesnt want to pay it and I dont want him to pay it either. Fortunately his car is still drivable but dont know yet how much repairs would be. Its a pretty new car too.

Since the other guy didnt have insurance, I probably would have called the cops but they may or may not come out if no one is hurt in the accident. Although hell they may rush to come arrest someone with no insurance.

That being said, if the dude didnt have insurance then he almost certainly does not have the money to pay for the damages so Im really not sure there is much more your brother can do other than going through his own insurance and paying the deductible. Yes it sucks but its an unfortunate luck if the draw. Going after the other guy will almost certainly be an unfruitful waste of time.

However if he does have the money to pay for damages then your brother should try to work with him as much as possible to let him correct his mistake.

Your brother should talk to his insurance company. They might be willing to subrogate, in that they'll cover his damages then go after the other dude for the money.

If he was offered un/under insured motorist PD coverage and declined, he might have no options at that point.

Always get police report if ever involved in a car accident no matter what. People only lookout for themselves tbh. Was your brother convinced aboutgetting rear ended? People lie about insurance.

Thanks yall. The cops did show up. My brother has insurance, but Im not sure what kind of coverage he has other than full coverage. Im still waiting on my brother to let me know if he got the guys information. I surely hope the insurance company can go after the guy for the cost or at least not make my brother pay the deductible.

The other driver told my brother I took my eyes off the road for just a second. Or something similar to that. His car got hit pretty dang hard. Its a 2019.
