I just called to get an update today. They said they were going to deny the claim because they have immunity when they aren't negligent and the vehicle did not hit my car. They then said they made a "business decision" to cover half of the damages.

I literally pulled up the definition of negligence:

negligent

1. failing to take proper care in doing something.

I argued that the driver IS negligent in this case because he failed to secure the cones on the front of the car. They argued that the driver DID secure them, but something caused them to fall off. I argued that the fact that they fell off means they weren't secured. If something is secured to the vehicle, it doesn't fall off. If I just put a ladder on top of my car and drive around without securing it and it falls off, I'm responsible for any damage that causes to other vehicles that happen to run over the ladder. They then tried to argue that it doesn't matter because only one cone fell off.

OBJECTION!!!

I have a total of 6 videos that show that multiple cones fell off of the truck. I only sent them one of them because I didn't think the other videos were relevant. The other cones didn't damage my car. I probably should have sent them all of the videos up front, but I'm going to do that in a few minutes.

They are now agreeing to pay for the full cost of the damages ($600) to replace the paint protection film that was scratched.

They're just going to send me a form to sign and send back so that they can mail me a check for $600.

Woo.

I feel like I just pulled a Phoenix Wright level move.

I managed to get the form sent back to them in time. I had to go to work to print it out, get it notarized, then go back to work to scan and email it, lol.

I'm now "in line for payment."

Yeah. Fortunately, I was prepared for them to say they were denying the claim. I have been running through a few arguments I could make since this happened a couple weeks ago.
