https://news.yahoo.com/black-oklahoma-man-faces-first-degree-murder-charge-after-killing-white-burglar-205612621.html

He owned a Marijuana store and a white guy tried to break in late at night while the owner was still in the store. Robber got shot and died. Then The owner of the store was arrested and charged with murder

I have mixed feelings about this. I dont know for sure he needed to kill the guy but..... it's pretty obvious if the races were reversed, this probably wouldn't even go to trial

His prerogative how to deal with an intruder. I catch someone in my home or garage, idgaf what they're intentions are. Mine will be the last door they open

whose business license expired a year later. Bratcher had planned to renew his license in 2019, his wife said, but learned he would not be allowed to do so until he made nearly $100,000 worth of renovations to the warehouse that housed it, so he held off.

so his "business" is about as legit as a back shed grow op. those renovations he needed are no joke, the place literally needs to be burglar proof without needing to stand around with a gun all night. shit situation all around though.

just going off what the article states

He was trying to break in when the business owner, who was inside the business at the time, apparently opened fire with a handgun, striking and killing the man who was breaking in, Master Sgt. Gary Knight with the Oklahoma City Police Department told KFOR.

the guy wasnt even in the store. He was at a locked door and he fired at him and killed him.

and before this goes into a racial thing, we have had instances where white people shooting intruders has gone to trial and those were cases where the intruder got into the house.

What does that have to do with self defense? Someone was breaking in, he defended himself. if it was a cop he would just say "I WAS SCARED" and get off free.

Apparently the stand your ground or castle doctrine isn't allowed to people charged with a felony. And he was initially arrested for operating an illegal weed store cause his license lapsed. But its bullshit. He still has the right to defend himself. They got him on a technicality

I think the important thing is if the intruder actually entered the store. If he couldnt get past the locked door and he fired through the door to kill him is that really self defense?

While I seriously doubt that considering how many other cases it hasn't been applied (and I wonder if the *nature* of the business wasn't the biggest factor here), this case is still outrageous. Shop owners should absolutely have a right to defend their businesses against burglars. Hopefully these charges are dropped before the case goes to trial.

In 2018 when Oklahoma voters legalized medical marijuana, Bratcher established Premium Smoke LLC, a marijuana grow shop located in Oklahoma City, whose business license expired a year later. Bratcher had planned to renew his license in 2019, his wife said, but learned he would not be allowed to do so until he made nearly $100,000 worth of renovations to the warehouse that housed it, so he held off

Okay, maybe that could have been a factor.

On May 27, 2020, around 1 a.m., Bratcher was at the grow operation warehouse when Daniel Hardwick, a 42-year-old white man, allegedly attempted to break into the business for the second consecutive night. Video from that night reportedly shows Hardwick park his car at the rear of the shop, walk to the businesss door and jostle with the door handle, attempting to gain entry.

He was trying to break in when the business owner, who was inside the business at the time, apparently opened fire with a handgun, striking and killing the man who was breaking in, Master Sgt. Gary Knight with the Oklahoma City Police Department told KFOR.

...so he shot somebody for jostling the front door? You know, I'm starting to find this a little hard to defend.

The way the story was framed, I thought the guy had broken into the store, not merely tried to open the front door and then got shot through the door.

Bratcher called the police shortly after the shooting, and once at the scene, officers called the Oklahoma Medical Marijuana Authority to ensure the business was legal. When they found out that the businesss license had expired, Bratcher was arrested for operating a grow shop illegally, a felony, and was held on $5,000 bond. He was not, however, initially arrested in Hardwicks death. In addition to arresting Bratcher, authorities also seized 480 marijuana plants worth an estimated $1,500,000.

I guess the cops were just going to let the killing slide but then the DA reviewed the tapes? Kinda guessing if the business was legal, the DA might have sided with the owner even though shooting into the street like that could have killed anybody.

lmao. hes not a cop though. hes a dude who got caught self defending $1,500,000 worth of illegal pot (but thats a whole seperate thing whatever). my point here is the whole license thing for growing weed and keeping it SECURE is to prevent shit like this. the owner decided to ignore that. im not bringing class or color to the table here, and definitely not defending the burglar either, probably a right dickhead that got what was coming too.

That's not defending by the sounds of it. The guy straight up killed someone rather than telling the guy to leave. It was an unnecessary and excessive amount of force to get the job done.

Dude didn't make it inside the store. That's not self defense that's murder.

Plus it sounds like by state rules he doesn't have castle doctrine rights anyway.

It pains me to say this : the guy was not in the store, you can't shoot or defend with lethal force before the person gets past the lock, and inside the store/property. The owner should have told him to get the fuck away or waited for him to actually be inside before choosing lethal force or just holding him until police arrived.

Either you're trolling or your not so subtle racism is showing.

If this was reversed, you know damn well that he'd not only go straight to prison, the mainstream news will cover this story 24/7 and the pitchforks would all come out with LeBron tweeting "you're next" and the jurors would get pressured into convicting him

It is technically defending because the criminal was caught in the act but the owner didn't have the right to shoot and murder him before he was inside and even then if he got inside, noticed he was seen and tried to immediately flee the owner couldn't shoot him on the way out either, unless he could prove he was still in danger somehow. Funny how the law is skewed towards defending criminals and their rights compared to their victims, but I guess the cops got to extort money out of the citizens somehow, even if they are career criminals.
