Through forfeiture over 80% of Madoff's stolen funds were repaid. It's still millions lost forever but it seems more for lack of existence and not that the money was untouchable.

There's really only one way to make sure your money is untouchable and that is to convert it all to a local currency in a government that has no extradition to the US and leave it in their banks.

It was spent on things that cannot be reclaimed like bills for his million dollar penthouse and extravagant travel expenses. They may have managed to hide some but it would be a tiny fraction of what they couldn't recover.

Whatever they did have left clearly wasn't much since Madoff's son killed himself (imagine killing yourself rather than live an averagely affluent life)

Btw even if he does get to a point of being arrested, thats not what happens with rich people. Don gets to pick a time and place that him and his lawyers get to turn themselves in. Chappell figured it out like 20 years ago.
