Technically you need to enable dev mode which supposedly has some of its own issues. Xbox encourages people to use Dev Mode, not necessarily to home-brew stuff.
Also, you can just put RetroArch on your Series S/X without breaking the warranty. Emulating games across the board is very much a "fine line" in terms of legality. ... Copied to Clipboard!
