Things are fair and the Republicans have just managed to finally undo decades of Democrat gerrymandering and court packing stretching back to FDR.

Also, I'm pretty doubtful they actually overturn Roe v. Wade. Think it's more likely they find a way to limit it without actually taking the final step of overturning it.

Theres currently a norm against court packing that is preventing either side from doing it. Such a norm does not exist for gerrymandering, so if one side restrains themselves they just get screwed. For gerrymandering I think most of us agree that it would be preferable if such a norm did exist, so I find it interesting that so many people here are so pro-packing when both sides pack is pretty clearly worse than neither side packs (especially with a huge structural advantage for the GOP in the Senate!)

Okay, but in your hypothetical if we assume Biden gets 2 terms then we'd have 8 years of conservative-dominated SCOTUS followed by however many more years of conservative-dominated SCOTUS, whereas if Dems just fucking packed the court we would have 8 years of liberal-dominated SCOTUS followed by however many years of conservative-dominated SCOTUS. Which sounds better to you?

In June they will only be 7 months away from a Senate that ought to be in GOP control for decades based on the inherent advantage of small states there. The only thing endangering the triumph of the conservative vision of the Constitution would be for the Democrats to pack the courts before then. And overturning Roe would dramatically increase the probability of that happening I think. From something very low to something that is still kinda low but feels risky.

The smart thing to do politically would be to kick the can down the road for now and then move forward with major precedential decisions after January 2023.

Well see here's the thing, I don't have a time machine. I can't go back in time and change the election of 2016. Nobody can. But you know what could be done today to mitigate the effects of Republicans fucking over the Supreme Court? Packing it with half a dozen 30-year old far-left law clerks with no unhealthy habits and living great grandparents.

And if the Republicans do eventually win back enough elections to pack the court with their own ideologues, and the makeup of SCOTUS continues to swing wildly back and forth every electoral cycle to the extent that voters can no longer ignore the incredibly fucking stupid way it's designed and run, and reforms are made to the Supreme Court to make it difficult or impossible for any one party to fuck with and dominate for generations on end, that's a feature and not a bug.
