Fuckin 8 years later. This is the case where a man was texting his babysitter during the previews and old mr bitch complained to staff about it. The two exchanged words, the texter threw some popcorn at him, so the old POS decided a reasonable response would be to shoot him.

I remember that. He stole a little girl's father . I know he's claiming he "feared for his life" though. But I think witnesses that day have blown holes in his argument

Yup. His defense team claimed a phone was thrown and a punch was about to be thrown. All witnesses said he just threw some popcorn at him. The judge already slapped down his stand your ground argument. Thats what they immediately tried to go with.

Would Stand Your Ground have applied though? Reeves (the shooter) started the altercation by arguing with Olson over texting.

@UnfairRepresent I remember you being well versed in this. Even though Reeves left the theater and came back, it started because he went after Olson initially?

I haven't followed this case at all but I don't see how you can claim stand your ground if you left an altercation voluntarily and then came back into the altercation voluntarily. Even ignoring the gun.

That's escalation even if the other guy was a douche.

Self defense laws would still apply obviously but I don't see how Stand Your Ground possibly could.

The whole point of Stand Your Ground is a situation where you have no choice but to pre-emptively defend yourself in a dangerous situation. If you left and came back, then "no choice" is out of the window.

Thanks - SYG seems problematic for that reason (claiming there was past history or whatever)

not at all. he started the confrontation, left, and came back to continue arguing. He had absolutely no reason to believe his life was in danger.
