funny enough displaying a gun with the intention to scare other people is also considered disorderly conducts

But I doubt any officer would actually follow that part of the law

Idk about Texas but here a guy got arrested for open carrying in a Walmart. Open carry is legal here and at least back then (dunno about now) Walmart didn't forbid guns in the store. Guy got the charges dropped but still spent the night in jail over it.

High crime city so I understand the guybwanting to carry. Kinda understand the cops concern cause high crime area but two things. One he didn't know the law on it apparently and two people who are out to commit a crime typically don't open carry.

Here in Arizona, they only added a no open carry sign at the entrance within the last 2 years or so

despite this, everyone still open carries at Walmart

A reasonable suspicion stop( Terry stop) has a maximum detention time of 60 minutes. If you have a probable cause for an arrest they are ultimately going to jail. Anything outside of the hour is illegal

thats not how it works. The cops not knowing or caring about the law isnt the same as it being legal for them to do so.

unlawful detention is a thing for a reason.

its literally protected by the first amendment. You need to be civil and not cause a disturbance, and courts have sided against people before, but its sided with free speech far more than against it.

Cops can find ways to fuck with you for it but you are absolutely allowed to express your disdain towards a police officer.

Whats the caselaw on this? The Supreme Court has always been tentative to put hard time limits on RAS/Terry stops.

If were talking vehicle stops and waiting for a k9, the Supreme Court has upheld up to 90 minutes. They didnt cap it there, but obviously you need some way to articulate why you would need more time than that.

Pedestrian Terry Stops are going to be way harder to justify that kind of time span, so 60 minutes wouldnt be a stretch. I just havent seen it anywhere.

Yeah vehicle stops are way easier. Our state has it clearly written at 60 minutes for RS. But a lawyer that gave a class and said if you IDd somebody and you have literally nothing on them after your initial RS to let them go immediately. Some guys are getting sued right now for IDing a passenger during a traffic stop rn

Yeah, thats a good way to think about it.

I try for consensual encounters as much as possible, and I wont push a pedestrian stop unless Ive got a mountain of RAS prior to contact.

In my state, passengers only ID by consent unless you have RAS of criminal activity in the vehicle behind the stop. I know some states have stop and ID laws, so Im sure its different there, but we can ask. They can tell us to fuck off if they want, and it is what it is.
