All of this was an excessive use of power. Was he a disrespectful punk? Yeah, but that doesn't mean he deserves charges and JAIL. Holy shit a teenager at school is acting out? School staff should be able to handle something as simple as that. He didn't put his hands on anyone. He just had an attitude. If being a mouthy dick was enough for jail time, you'd have to put 90% of teens in jail.

I didn't really see anything wrong with what the kid did. Sure he was mouthing off but then why was the cop putting his hands on him and then following him after he stepped off?

Edit. After reading the article, the cop still wasn't nrcessary.

He seems to be threatening him and resisting arrest.

Reminder that certain types would have justified this kid being shot dead for "resisting arrest". Or really just reacting to having his throat grabbed.

I find it hard to sympathize with anyone who just mouths off to an authority figure. Just take the L and make a complaint through the proper channels. Mouthing off and acting the fool is only going to give them the power to fuck you up.

Kids literally mouth off to authority figures all the time. You certainly won't fix that by giving them criminal records

Giving them criminal records puts them in the system, which makes it easier to punish them harshly in the future.

SRO tried repeatedly to get him to get his stuff and leave, he refused.

I'm finding it hard to feel any real sympathy for the student here just from what was shown.

I appreciate pogo's honesty in excusing violence against people he doesn't like, which is what most conservatives are thinking but won't come out and say it.

In theory we are supposed to be allowed to defend ourselves against unlawful cops. The problem is the unlawful cops never believe they are unlawful and they kill you. Later maybe you will get exonerated but you are still dead. In practice, we are fucked. That kid did nothing wrong but the justice system is going to fuck him over anyway

No. We don't have to obey an unlawful order. These days, most cop orders are unlawful. Cops don't even know their own law. Or they don't care

Is the cop also still in high school? His immaturity could literally get this kid killed. Why the fuck would you fuck with his pride when you're the one that's supposed to be defusing the situation.

I swear. It's like this cop wants to be everyone's dad. Except as soon as they're parenting style doesn't work, then you're no longer someone they're trying to son, you're a straight up criminal and they have a gun. That's why you comply in the moment, so you don't get shot, manhandled, or sent to jail. You then sue the city/state after the fact for the cop's actions.

When you're in court and the cop's dash/bodycam footage gets shown, if they see a compliant nonresistant, non-verbaly abusive victim, the cops won't have a leg to stand on.

Great way to escalate the situation. Deciding whether it's an unlawful order or not is something to sort out in a court case, not right there on the spot during an arrest.

It's not so simple when complying sometimes doesn't save you from being killed anyway and courts decide the officer is not guilty because you honestly told them you have a weapon (2A rights) and they proceed to panic.

There's also the issue that allowing cops to violate your rights makes them more comfortable violating the rights of other people. That's not to say that it won't increase your survival odds, but "Just comply and let the courts deal with it" is essentially saying you should surrender your rights even in unjustified situations (Debatable as that might be).

Hell something as simple as not pulling over right away, because you want to wait until you're in a safe, well lit area, can get you hurt/killed because that can be misinterpreted as "non compliance". Even though it is both well within your rights and makes the encounter safer for the cop as well.
