I suppose it can be abused, but you would hope that anyone watching Jones would hold what he has to say with a molecule of salt. He is the most outrageous of anyone using this defense. I never met anyone that thought he was more than a meme. Maybe the bath salts crowd believes him, but if you cast a wide enough net (and the internet is a enormously wide net) you will find people that believe almost anything. And if you can be held liable for the actions of a bunch of crazies, you pretty much can't say or do anything.

But, legality aside it is probably for the best that the families get something for thier troubles. Maybe not 50 million dollars a person, I mean it was not like Jones killed thier kids, but perhaps 5 mil a pop, so they can have a comfortable retirement. It is best to sheer the sheep not skin it.

You can hope it but I don't know why you would. Back in the day before he got black listed off all legitimate media platforms I tried to watch him for "humor" value and wasn't able to it because of how crazy it was.

You can't even really claim a mental illness in a civil trial, at least not in the traditional sense. Although I guess the flip side of that is you don't have the same limitations as you would in a criminal trial of not understanding the consequences of your actions. Essentially it would be rolling to dice on who the jury would feel more sympathy for, which is a high bar when the other side is a bunch of parents that had their kids murdered.

The "no reasonable person" defense should only be applicable if the only victim is the unreasonable person. So if Alex Jones says that bath salts will cure your cancer, and an unreasonable person buys them, they don't have a case against Jones. But if Jones says "these people are fraudsters trying to take away your guns" and an unreasonable person harasses those targets, Jones is liable.
