The waiver is likely unenforceable in court. The CEO knew it was dangerous. He was warned. He's on camera saying he knew it was dangerous but disregarded the experts.

I guess it depends what was actually in the contracts. If the sub was actually as poorly designed to not really be able to handle those depths as some have argued, you can probably have good cause for a lawsuit based on the poor standards.

If you can get experts to say the Titanic sub is ****, then you can probably argue that those who signed the contracts agreed to the risks under the expectation that the titanic sub was actually capable of accomplishing its intended task - not the extreme risk associated with poor build quality. If the people who agreed to the contract did so under the impression that everything was actually designed to work, they were led to believe they were accepting a smaller amount of risk than was actually present, which can probably void the waiving liability thing.

Not a lawyer tho, so what do I know.

Waivers dont actually take away your ability to sue. They dont hold up in court.
